Uber TCPA Violations

It has been a long year for Uber, between the Safe Ride Fees Class Action, Contractors vs. Employees Class Action, and Fair Credit Reporting Act Class Action I don’t know if they can afford to dish out much more settlement funds.

The newest class action lawsuit to settle by Uber was a Telephone Consumer Protection Act (TCPA) Lawsuit that alleged Uber robo-texted thousands of customers without their consent. The defendant of the case claimed Uber Technologies Inc. violated federal law by sending out mass texts in an effort to recruit new Uber drivers.

The class action settlement was approved for $20-million in August. The settlement funds will be distributed among qualifying class members on a pro rata basis. Each knowing violation of the TCPA can put a defendant on the hook for $500 to $1,500 in statutory damages.

There are three settlement Classes:

  • Settlement Class A covers “[a]ll persons or entities within the U.S. who, from December 31, 2010, up to and including August 17, 2017, used or subscribed to a wireless or cellular service and were sent one or more non-emergency text messages, utilizing Twilio Inc.’s system, in connection with Uber’s Refer-a-Friend Program.”
  • Settlement Class B covers “[a]ll persons or entities within the U.S. who, from December 31, 2010, up to and including August 17, 2017, started Uber’s driver application process but did not become an ‘active’ driver in Uber’s system, who used or subscribed to a wireless or cellular service, and to whom Uber sent one or more non-emergency text messages after the user or subscriber requested Uber to discontinue sending text messages.”
  • Settlement Class C covers “[a]ll persons or entities within the U.S. who, from December 31, 2010, up to and including August 17, 2017, were not party to a contract with Uber and/or who did not provide his or her cellular phone number to Uber, and who used or subscribed to a wireless or cellular service to which Uber sent one or more non-emergency text messages.”
