Anti-Epilepsy/Bipolar Prescription, Depakote, Birth Defect Settlement

Abbott Labs, the makers of an anti-epilepsy/bipolar prescription medication Depakote, have been ordered to pay out $15 million to plaintiff Stevie Gonzalez and his mother Christina Raquel, for failure to properly label and warn consumers of the side effects of the prescription.

Raquel gave birth to Gonzalez with spina bifida and was failed to be warned by the doctors of the 10% risk of giving birth to a child with major malformations and spina bifida. According to the reports to warning label states a 1-2% chance of birth defects.

Raquel and Gonzalez asked for nearly $40 million to cover lifelong medical care, wage loss, and emotional suffering. The verdict from the Jury awarded them $15 million.

This was the 6th case over Depakote to go to trial. Hundreds of suits have been filed against Abbott by mothers and children who say they were not told of the true dangers to developing fetuses when they were given the medication.
