Pending before the Court is Plaintiff Patrick Hendricks’ renewed motion for final approval. On February 19, 2013, Plaintiff filed this action in the Northern District of California. The Court held a final fairness hearing on December 17, 2015, and the second hearing on April 20, 2015.

The Complaint asserted claims under California Civil Code for Consumers Legal Remedies Act, Unfair Competition Law,  False Advertising Law, and for breach of express warranty, breach of implied warranty of merchantability, breach of implied warranty of fitness for a particular purpose, negligent misrepresentation, fraud, and unjust enrichment.

Payment Terms: In full settlement of the claims asserted in this lawsuit, StarKist agrees to pay $8,000,000 in cash and $4,000,000 in vouchers for StarKist products.
