Volvo Cars of North America LLC was slammed in New Jersey federal court on January 10th 2017 with a putative class action suit involving the XC90 SUV. The XC90 is Volvo’s flagship SUV with its rear park assist camera mounted directly in the tailgate, providing the driver with a perspective that includes the edge of the bumper and trailer hitch (if fitted). The complaint filed alleges that this system is very unreliable at best, with the camera freezing, and or not reverting to the normal screen when reverse gear is disengaged. This failure renders the entire integrated navigation screen useless until the camera “snaps out of it”.
This putative class action includes Violation of Magnuson-Moss Warranty Act, as well as breach of express warranty and breach of implied warranty of merchantability.
