The 9th U.S. Circuit Court of Appeals has reinstated a lawsuit against American Airlines who merged with US Airways promising to deliver passengers bags upon landing but failed to do so. The lawsuit seeks reimbursement for baggage fees passengers were forced to pay do to delayed or lost bags during the merging flights.
The plaintiff, Hayley Hickcox-Huffman, originally sought a $15 baggage fee reimbursement after her bag did not show up on a carousel following a US Airways flight to California. But now, the defendants may have to pay out a lot more than that because her lawsuit seeks class-action status on behalf of other passengers like herself.
